Well Beam, Inc. (“Well Beam,” “we,” and/or “us”) values the privacy of the individuals who use our website and related services (collectively, the “Service”). This privacy policy (the “Privacy Policy”) explains how we collect, use and share information from users of our Service (you”). By using our Service, you agree to the collection, use, disclosure, and procedures this Privacy Policy describes. Beyond the Privacy Policy, your use of our Service is also subject to our Terms of Service at well-beam.com/terms. Information We Collect We may collect a variety of information from or about you or your devices from various sources, as described below. Information You Provide to Us Access Credentials. To use the Service, you will need to receive access credentials, including an e-mail address and password, from an account administrator at the physician’s care team or home health agency with which you are associated. Once you sign in to the Service, you may be required to provide a mobile telephone number and may have an opportunity to update your password in connection with your account. User Data. We may collect any information you choose to upload to the Service and exchange with other users who have been assigned to a patient’s case, including messages, photos, videos, data, records, plans of care and order changes (“User Data”). You are responsible for providing and obtaining all required notices and consents for us to process User Data. Communications. If you contact us directly, we may receive additional information about you. For example, if you email our support team, we will receive information such as your name, email address, the contents of your message, any attachments you may send to us, and any other information you choose to provide. Information We Collect When You Use Our Service When you use our Service, we and our third party service providers may collect information from you through automated means, such as cookies, web beacons, and web server logs. By using the Service, you consent to the placement of cookies, beacons, and similar technologies in your browser and on emails in accordance with this Privacy Policy. The information collected in this manner includes IP address, browser characteristics, device IDs and characteristics, operating system version, language preferences, referring URLs, and information about the usage of our Service, including the pages or other content you view, the searches you conduct, and the dates and times of your visits. We may use this information, for example, to ensure that the Service functions properly, to understand the pages or other content you view and interact with, the searches you conduct, and the dates and times of your visits, or to prevent fraud. How We Share the Information We Collect

Other Users We may share User Data with other users of the Service who are assigned to the same patient’s case. Please be aware that any User Data you choose to exchange with other users will be accessible to other users who have been assigned to a patient’s case and we are not responsible for the manner in which other users use or disclose that User Data.

Third Party Services The Service allows you to, upon your direction, export information to third party services, such as electronic health records systems. You understand and agree that the use of such information by third party services will be governed by the privacy policies of these third party services and your settings on that service. We encourage you to review the privacy policies of such third party services.

Vendors and Service Providers. We may share any information we receive with vendors and service providers retained in connection with the provision of our Service. For example, we use analytics services to collect and process certain analytics data, including analytics services provided by Mixpanel. You can learn how to opt-out of Mixpanel’s collection of certain information by visiting https://mixpanel.com/optout. If you get a new computer, install a new browser, erase or otherwise alter your browser’s cookie file (including upgrading certain browsers) you may clear the cookie Mixpanel uses to recognize your opt-out request. The analytics services we use may also collect information about your use of other websites, apps, and online resources.

As Required by Law and Similar Disclosures We may access, preserve, and disclose your information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others’ rights, property, or safety.

Merger, Sale, or Other Asset Transfers We may transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our assets. Consent. We may also disclose your information with your permission.

Third Parties Our Service may contain links to other websites, products, or services that we do not own or operate. We are not responsible for the practices of these third parties. Please be aware that this Privacy Policy does not apply to your activities on these third party services or any information you disclose to these third parties. U.S. Health Care Laws Notwithstanding anything in this Privacy Policy to the contrary, to the extent we create, receive, maintain, use, or transmit “protected health information” (as such term is defined in 45 C.F.R 160.103) in providing the Services, we shall only use and disclose that information in accordance with applicable law, including the Health Insurance Portability and Accountability Act of 1996 as amended (“HIPAA”) and the terms of any Business Associate Agreement between Well Beam and the physician’s care team or home health agency with which you are associated.

Children We do not knowingly collect, maintain, or use personal information from children under 13 years of age, and no part of our Service is directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Policy, then you may alert us at support@well-beam.com.

International Transfers of Data Our Service is hosted in the United States. If you choose to use our Service from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing. Also, we may transfer your data from the U.S. to other countries or regions in connection with the storage and processing of data, fulfilling your requests, and operating the Service. By providing any information, including personal information, on or to the Service, you consent to such transfer, storage, and processing.
